Terms
By accessing, browsing, or using any services provided by SMART APPROACH CO., LTD. (“Smart Approach”, “Company”, “we”, “our”, or “us”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”).
Description of Services
Smart Approach provides wireless communication and identity-related products and services, including but not limited to: (a) RFID/NFC integration solutions, including NFC antenna modules and reader hardware; (b) wireless charging integration solutions; (c) Ultra-Wideband (UWB) integration solutions; (d) customized antenna and RF connector solutions; (e) digital ID cloud services, including identity verification software,digital credential issuance, certificate-based identity services, and integrations with digital wallet platforms such as Apple Wallet and Google Wallet; and (f) OBM/ODM/OEM product development and manufacturing services (collectively, the “Services”).
Role of Smart Approach
Depending on the deployment model, Smart Approach may act as:
- Verifier Registrar;
- Credential verification infrastructure provider;
- NFC identity solution provider;
- Certificate and trust management operator;
- Hardware and embedded integration partner.
The Company does not guarantee the accuracy, completeness, or reliability of identity data submitted by users, clients, or third parties.
User Obligations
Users, clients, and relying parties accessing or using the Services shall comply with all applicable laws and regulations and shall be solely responsible for ensuring that any data submitted is accurate, lawful, and obtained with appropriate consent.
Users shall not use the Services for any unlawful, fraudulent, or unauthorized purpose, including but not limited to identity misuse, credential tampering, or system interference.
License and Use Restrictions
Subject to compliance with these Terms, Smart Approach grants a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for authorized purposes.
Users shall not copy, modify, distribute, reverse engineer, decompile, or otherwise attempt to extract the source code or underlying structure of the Services, except as permitted by law.
Security and Infrastructure
Smart Approach implements commercially reasonable technical and organizational safeguards designed to support secure credential verification and identity infrastructure operations, including but not limited to:
- encrypted communication mechanisms;
- ECC/EC certificate infrastructure;
- PEM certificate support;
- secure key and certificate lifecycle management;
- authentication and access-control systems;
- secure NFC and credential exchange workflows.
Notwithstanding the foregoing, no security system or transmission method can be guaranteed to be completely secure or error-free.
Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis.
Smart Approach expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
The Company makes no representation that the Services will meet user requirements or operate without interruption.All information on the Company’s website and in accompanying documentation, including but not limited to product specifications and technical datasheets, is provided for informational purposes only and may contain errors or inaccuracies; such information is subject to change without notice, does not form part of these Terms, and does not constitute a warranty or representation of any kind.
Limitation of Liability
To the maximum extent permitted by applicable law, Smart Approach shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of, or inability to use, the Services.
Without limiting the foregoing, Smart Approach shall not be liable for any damages resulting from inaccurate data provided by users, misuse of credentials, or failures of third-party systems, including but not limited to digital wallet platforms.
Third-Party Services
The Services may integrate with or rely upon third-party platforms, including but not limited to Apple Wallet (VAS), Google Wallet (Smart Tap), NXP MIFARE-compatible systems, ISO/IEC 18013-5 compliant Mobile Driver’s License (mDL) ecosystems, and other identity or access control platforms.
Such third-party services are governed by their own terms and policies, and Smart Approach shall not be responsible for their availability, accuracy, or data practices.
Modifications to Terms
Smart Approach reserves the right to revise or update these Terms at any time in its sole discretion.
Any changes shall become effective immediately upon posting on the Company’s website. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
Termination
Smart Approach may suspend or terminate access to the Services at any time, without prior notice, if the user is found to be in violation of these Terms, engaged in fraudulent activity, or poses a compliance or security risk.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law principles.
